continuing?, small dark-legged, dark-billed peep on public beach, scoped with 20-40X in good light

Observed[scoped at 20-40x in decent light finally] gull smaller than nearby ring-billed gulls, all blackish bill, black legs, darker grey upperparts, with partial dark hood, white crescents around eye, 4 obvious white spots in folded primaries, all white tail with no terminal dark band was observed when the bird was scared off by Caspian tern, I did not get a good look at the top of the wings to see if dark outer part of primaries was separated from dark grey of wing; bird flew off to the south at 8:01 am. I looked for but did not see it with any of the gulls in the harbor later in the morning.
