    Comments: Saw this along the boardwalk. The pond was dry. The bird was mousing through a downed tree or large bush right next to the boardwalk. Bird was visible for at least five minutes. It was close - within 10 ft or so some of the time. Thought it was smaller than other empi's but didn't have comparison. Bird was olive all over but the breast was slightly lighter and yellower on lower breast. You could also see a bit of eye ring and faint wing bars. Posture and activity was inconsistent with a kinglet. And the crest was evident when bird perched higher in the bush a few times. Bird did not vocalize. Later, we heard this species had been seen in this neighborhood. We believe we were mistaken in initially ID'ing as NBTY.
